Airadigm Communications, Inc. (“Airadigm”), the provider of AirFire Mobile (“AirFire”) wireless services, is committed to providing all of its customers with the best online experience possible. Airadigm does not block end users from accessing lawful websites, subject to reasonable network management, nor do we block applications that compete with our voice or video telephony services, subject to reasonable network management.

Acceptable Uses

Airadigm permits the use of its broadband services for browsing the Internet (via AirFire phones or devices), using email, downloading legally permissible content via the Internet, accessing and using corporate email and/or corporate business applications associated with its customers’ places of employment. Service is not intended to provide full-time data connections, and the service may be disconnected after sessions of excessive usage.

Service Description and Performance Characteristics

AirFire allows its customers to choose from two rate plans with no capacity limits, but differing service areas. Information on these plans is available on our website at www.airfiremobile.com. The typical speed range of broadband service experienced by most customers is 60-150 Kbps down and 25-75 Kbps up. Airadigm measures its network performance utilizing the following performance measurements and methodology. Airadigm reviews network performance reports from our core network elements. In addition, we use an FTP and/or web server located at our data center that details approximate latency and speeds that are within Airadigm controls. We continue to monitor our Packet Data Service Node for network bottlenecks and latency. Airadigm believes this approach provides the best approximation of actual speeds and latency for its service. Customers can verify speed using a variety of third-party websites to measure the provisional speeds of AirFire’s broadband service. The FCC has released a free Mobile Consumer Broadband Test for the Apple iPhone and Android mobile platforms. The official name of the App is the “FCC Mobile Broadband Test.” This tool can be downloaded to your Apple or Android enabled device by accessing the App store on your handheld phone. Such third-party websites are not affiliated with Airadigm and Airadigm does not make any guarantees as to the accuracy of test results obtained through those third-parties. Actual speeds may vary due to area, coverage, and compression, among other factors.

Network Management Practices

Airadigm does not block applications, impose usage limits, or engage in “throttling” to reduce the throughput to customers using a disproportionate amount of bandwidth. Instead, Airadigm uses an “open pipe” approach and undertakes best efforts to ensure a high-quality online experience for all of its customers. As a result, at times of heavy usage, customers may experience delays in downloading or uploading files or a sluggish Web surfing experience. Airadigm may deny service or terminate service to anyone it believes is using the service in any manner prohibited, whose usage adversely impacts the network, service levels of other customers, or hinders access to the network.

Device Restrictions

AirFire allows you to buy your device from us or from someone else; however, we do not provide settings or support for devices that were not bought from us. Your device must comply with Federal Communications Commission regulations and be compatible with our network and your calling plan. If you did not buy your wireless device from us, Airadigm does not in any way warrant that your device will operate without error on our network, will operate without the need for periodic upgrades or modifications, or will not be adversely affected by network-related modifications, upgrades or similar activity. Security Measures

AirFire offers its wireless broadband customers unrestricted access to all of the lawful content, services, and applications available on the Internet. Airadigm uses tools (such as a firewall) and policies to secure its network to help reduce security risks; however, Airadigm does not use tools to block spam, malware, spyware or other unwanted or harmful Internet content. AirFire strongly recommends that its customers install a mobile security application to their phone or device. These tools can be downloaded to your Apple or Android enabled device by accessing the App store on your handheld phone. Such third-party applications are not affiliated with Airadigm and Airadigm does not make any guarantees as to the effectiveness or degree of security obtained through those third-parties.
